By using PortraitWorks Basic™ Basic, you acknowledge and agree to all terms put forth here. This EULA is solely concluded between Worldspinner LLC® and you. Worldspinner is solely responsible for PortraitWorks Basic and the content thereof, and reserves all rights in and to PortraitWorks Basic not expressly granted to you under this EULA.

Scope of License

This is a non-exclusive, worldwide license to use PortraitWorks Basic on any devices that you own or control.

If you have not purchased a Publisher License: Worldspinner grants you a non-commercial license for use of portraits produced by PortraitWorks Basic, and derivative works. You may export them to any devices, and share them with others for free, including individually or via social media. This license does NOT grant you any rights to sell a physical or digital item or access which contains any graphic elements of or output from PortraitWorks Basic, or derivative works.

You may export portraits to any devices, and share them with others including individually or via social media.

This license does NOT grant the right to use any of the source code or assets for any use other than to run PortraitWorks Basic.

Publisher License

If and only if you have purchased a Publisher License from Worldspinner (available in the PortraitWorks Basic Store): Worldspinner grants you a commercial license to use for profit portraits produced by PortraitWorks Basic. You may sell physical or digital items which contain portraits produced by PortraitWorks Basic, with no additional license fees due to Worldspinner.

When publishing paid products or services which includes portraits produced by PortraitWorks Basic, or derivative works:
Include the attribution “Portraits created with PortraitWorks Basic™ by Worldspinner™”. Only one attribution is required per product (e.g. on a card box or one page of a book).
Send an email to champion@worldspinner.com stating the name of the product, and a copy of your receipt for the Publisher License, showing the email for which it was purchased.

No redistribution of content elements

You may not redistribute individual graphical elements from PortraitWorks Basic outside the context of a portrait created by the application. This includes but is not limited to using PortraitWorks Basic content to create any other form of interactive or automatic graphical generator, or any other application or software which is potentially similar to or competitive with PortraitWorks Basic, or distributing individual assets in any way that would allow others to combine them.

Consent to Use of Data

Worldspinner may collect technical data that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the PortraitWorks Basic. Worldspinner may use this information, as long as it is in a form that does not personally identify you, to improve its products.

Prohibited Uses

You are prohibited from using PortraitWorks Basic for any unlawful purpose; to infringe upon or violate our intellectual property rights or the intellectual property rights of others; to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.

Maintenance and Support

Worldspinner will be the sole provider of any maintenance and support with respect to PortraitWorks Basic, but does not commit to any maintenance or support beyond that required under applicable law.

Warranty

To the maximum extent permitted by applicable law, Worldspinner makes no claims and offers no warranty with respect to PortraitWorks Basic.

Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Termination

This EULA is effective until terminated by you or Worldspinner. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms.

Governing Law

This EULA shall be governed by and construed in accordance with the laws of the State of California.
